| Description: | The legal landscape affecting LGBT clients is constantly shifting. Same-sex couples were granted the right to marry in New York in June 2011. Given the lack of recognition of marriages on the Federal level due to the Defense of Marriage Act (DOMA), unique challenges face clients and collaborative practitioners when assisting LGBT clients in negotiating pre- or post-nuptial agreements, parenting agreements and separation/divorce agreements. The United States Supreme Court recently agreed to take two same-sex marriage cases, which will impact the rights of LGBT clients for years to come. The lack of legal protection for both parents in many situations poses challenges best met by a team approach with coaches and child specialist. The tax and financial aspects are complex and require the assistance of financial and tax specialists.
About the Program:
This half-day program will cover the needs of the LGBT community and what collaborative practitioners need to know to best serve LGBT clients; changes and challenges in the legal arena, including DOMA and non-recognition in other states; tax and financial complications presented by DOMA; what is different when same-sex couples marry and divorce; the kinds of agreements that can be negotiated collaboratively to effectively deal with legal and societal challenges; and the importance of coaches and child specialists in addressing power imbalances resulting from non-recognition of parenting and other legal rights.

| Presenters: | Mariette Geldenhuys has practiced law in Ithaca, New York for the past twenty-four years, in areas which include family and matrimonial law; lesbian, gay, bisexual and transgender (LGBT) family law; estate planning, adoption, small business advising, and municipal law. Ten years ago, she shifted the focus of her practice to collaborative law and mediation, to help clients resolve legal issues in a respectful, client-centered way and without litigation. Mariette is the Founder and Founding President of the Ithaca Area Collaborative Law Professionals. She was one of the four attorneys who represented the 'Ithaca 50' pro bono in the lawsuit seeking marriage equality for same-sex couples. Mariette is a member of the National Family Law Advisory Council of the National Center for Lesbian Rights and the New York State Bar Association Committee on LGBT People and the Law.
